1. Overview

This website, outtamind.club, is operated by OUTTA MIND CLUB, based in Montréal, Quebec, Canada ("we", "us", "our"). By visiting the site or placing an order, you agree to these Terms of Service and to our Refund, Shipping, and Privacy Policies, which are part of these terms.

2. Eligibility and content

You must be at least the age of majority in your province, state, or country to purchase from us. Our designs feature adult, edgy humour. They are satire and parody, intended for entertainment, and are not meant to target or offend any individual or group. By buying, you confirm you are comfortable with this type of content.

3. Products

All items are printed on demand. We do our best to show colours, prints, and sizes accurately, but slight variations in colour, print placement, and measurements can occur and are not considered defects. Please check the size guide before ordering.

4. Pricing and orders

Prices are shown in the currency displayed at checkout and may change without notice. We reserve the right to refuse, limit, or cancel any order, including orders that appear fraudulent, are placed by resellers, or contain a pricing or listing error. If we cancel an order you have already paid for, we refund you in full.

5. Payment

Payment is processed securely through Shopify and its payment partners. We never store your full card details. If you file a chargeback without first contacting us, we may dispute it and suspend future orders.

6. Shipping, returns, and refunds

Shipping is governed by our Shipping Policy. Returns and refunds are governed by our Refund Policy.

7. Intellectual property

All designs, logos, text, images, and other content on this site belong to OUTTA MIND CLUB or its licensors. They may not be copied, reproduced, resold, or used commercially without our written permission. Buying a product does not give you any rights to its design.

8. Reviews and user content

By submitting a review, photo, or tagging us on social media, you allow us to repost and use that content, with credit, on our site and channels, free of charge. We may remove any content we judge inappropriate.

9. Prohibited use

You agree not to use the site for any unlawful purpose, to interfere with its security or operation, or to scrape, copy, or resell our products or designs without permission.

10. Limitation of liability

The site and products are provided "as is". To the fullest extent permitted by law, our total liability for any claim related to a purchase is limited to the amount you paid for that order. We are not liable for indirect or consequential damages. Nothing in these terms excludes rights that cannot be excluded under applicable consumer protection law, including the Quebec Consumer Protection Act.

11. Third-party services

We use third-party services, such as Shopify, payment processors, carriers, and print partners. We are not responsible for their acts or omissions beyond what the law requires.

12. Changes

We may update these terms at any time. The version posted on this site at the time of your order applies to that order.

13. Governing law

These terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there. Any dispute is subject to the courts of the judicial district of Montréal, except where consumer protection law grants you the right to sue in your own jurisdiction.
